- Modify, reverse-engineer, decompile, or create derivative works;
- Rent, lease, sublicense, or otherwise transfer your rights.
3. Subscription services
ZimanGo offers auto-renewable paid subscription tiers that provide access to enhanced features, which may include but are not limited to:
- Exclusive educational content and tools;
- Customization options and digital rewards;
- Badges, rankings, or other recognition systems.
Subscriptions are billed through the Apple App Store or Google Play, depending on your device, and are non-refundable except where required by law. You are responsible for managing your subscription, including cancellations, through your Apple ID or Google Play account settings. We may modify, enhance, or remove features at our sole discretion without prior notice or liability.
4. User content and conduct
If the Service permits uploading, posting, or sharing content (e.g., comments, quotes, audio recordings, images, or learning materials), you agree that:
- You own or have the necessary rights to all content you submit;
- You grant ZimanGo a worldwide, royalty-free, perpetual license to use, host, reproduce, and distribute your content for purposes related to the Service;
- Your content does not violate any law, infringe any third-party rights, or contain offensive, harmful, or misleading material.
ZimanGo reserves the right to remove any content or suspend accounts that violate these Terms, without notice.
5. Prohibited activities
You agree not to:
- Use the Service for illegal, abusive, or fraudulent purposes;
- Impersonate another person or misrepresent your affiliation;
- Circumvent or attempt to breach security measures;
- Interfere with the Service's operation or disrupt other users' access;
- Use bots, scrapers, or other automated means to access the Service.
Violation of this section may result in immediate suspension or termination of your account and potential legal action.
6. Privacy
Your privacy is important to us. ZimanGo collects and uses your information in accordance with our Privacy Policy, which forms a part of these Terms. Please review it carefully to understand our data practices.
7. Communications and marketing
By using the Service, you consent to receive messages from ZimanGo, including email notifications, updates, and promotional materials. You may opt out of non-essential communications at any time through the app or by contacting us.
8. Account security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify ZimanGo immediately of any unauthorized access or suspected breach of your account. ZimanGo is not liable for any loss or damage resulting from unauthorized use due to your failure to safeguard your account.
9. Third-party services
The Service may contain links to, or rely on, third-party services (e.g., Firebase, analytics, or email providers). ZimanGo does not control these services and is not responsible for their content, terms, or data practices.
10. Termination
ZimanGo may suspend or terminate your access to the Service at any time, with or without cause or notice, particularly if you breach these Terms. Upon termination, your right to use the Service will immediately cease, and any content or data associated with your account may be deleted, unless otherwise required by law.
11. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee uninterrupted, error-free operation or that the content is accurate or up to date. To the fullest extent permitted by law, ZimanGo disclaims all warranties, express or implied, including fitness for a particular purpose, merchantability, and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, ZimanGo shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Service — even if we have been advised of the possibility of such damages. Our total liability for any claim under these Terms shall not exceed the amount you paid (if any) to ZimanGo in the past twelve (12) months. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
13. Indemnification
You agree to indemnify, defend, and hold harmless ZimanGo, its officers, employees, contractors, and affiliates from any claims, damages, liabilities, losses, or expenses arising out of your violation of these Terms, misuse of the Service, or infringement of third-party rights or laws.
14. Force majeure
ZimanGo is not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, internet outages, power failures, labor disputes, or legal restrictions.
15. Changes to these Terms
We may modify these Terms from time to time. If we make material changes, we will notify you through the app or by other means. Continued use of the Service after changes become effective constitutes acceptance of the new Terms.
16. Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict-of-law principles. The courts of England and Wales shall have exclusive jurisdiction, except where mandatory consumer-protection laws of your country of residence grant you additional rights.
